Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of cafekonnect.com (the "Site"), operated by Cafe Konnect ("Cafe Konnect," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you don't agree, please don't use the Site.

Use of This Site

This Site is provided to share information about Cafe Konnect's product and to let restaurant groups request access to a demo or showcase app. You agree to use the Site only for lawful purposes, and not to:

  • Submit false or misleading information through our forms
  • Attempt to gain unauthorized access to the Site, our systems, or any showcase/demo environment
  • Scrape, copy, or reverse-engineer the Site or its content beyond normal browsing
  • Interfere with the Site's normal operation or security

Showcase and Demo Access

If you request access to a live showcase or demo app, that environment is a limited, non-production example provided solely for your own evaluation. It may contain sample or generic data, may be modified, paused, or discontinued at any time without notice, and is provided "as is" with no commitment regarding uptime, features, or future availability. Access to a showcase or demo does not create any subscription, purchase obligation, or production service commitment.

Intellectual Property

The Cafe Konnect name, logo, and the content, design, and organization of this Site are owned by Cafe Konnect or our licensors and are protected by intellectual property laws. You may view and print pages from the Site for your own personal or internal business evaluation, but you may not otherwise reproduce, distribute, or create derivative works from this Site's content without our prior written permission.

Third-Party Links and Services

This Site may include links to, or embedded content from, third-party services (for example, Google Fonts or a Google Calendar scheduling widget). We don't control and aren't responsible for the content, policies, or practices of any third-party service.

No Professional Advice

Content on this Site — including statistics, comparisons, and claims about loyalty program performance — is provided for general informational and marketing purposes only. It is not legal, financial, tax, or business advice, and shouldn't be relied on as such.

THIS SITE, AND ANY DEMO OR SHOWCASE APP MADE AVAILABLE THROUGH IT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAFE KONNECT AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THIS SITE OR ANY DEMO/SHOWCASE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE AMOUNT, IF ANY, YOU HAVE PAID TO CAFE KONNECT IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold Cafe Konnect harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Utah.

Relationship to Product Agreements

If you become a paying Cafe Konnect customer, your use of the Cafe Konnect product (as opposed to this marketing website) is governed by a separate subscription or service agreement signed at onboarding. If anything in these Terms conflicts with that agreement, the signed agreement controls for your use of the product.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
